These terms apply to auctions run on fateseeker.art by Raphaela Raudaschl, Hamerlingstraße 7, 4040 Linz, Austria (business@fateseeker.art) — “the seller”. Full company details are in the Imprint. “You” means anyone registering to bid.

These terms don’t affect any consumer protection rights you have under mandatory law in your country of residence.

1. Registering to bid

Bidding requires registering with a working email address and confirming it via the link we send you. One registration per person; registering on behalf of someone else, or with intent not to pay, is not allowed and can get a registration revoked.

2. How the auction works

• Bids are placed in whole increments of the minimum step shown on the auction page.
• The highest bid standing when the auction closes wins. There is no reserve price.
• A bid in the last few minutes of the auction (as stated on the auction page) extends the closing time by the same amount, so a late bid can’t win purely by timing.
• Bids are binding and can’t be withdrawn. The only exception is an obvious input mistake (for example a typo adding a digit), raised before the final hour of the auction, and only at the seller’s discretion.

3. What winning means

The winning bid is an offer to buy at that price, which the seller accepts by inviting you to complete payment on a private Etsy listing set to your winning amount. The purchase contract for the item is formed at that point, on Etsy, between you and the seller — Etsy processes payment and provides its own buyer protections, but the seller remains the contracting party and these terms still apply to the sale.

4. Payment

Payment (card or PayPal, via the Etsy listing) is due within 2 days of the auction closing. If payment hasn’t cleared by then, the offer lapses, the item goes to the next-highest bidder instead, and the seller may decline to sell to you in future auctions. This doesn’t limit any other remedy available to the seller under applicable law.

5. Shipping

• Shipping is insured and tracked, and posted within 3 working days of payment clearing.
• Shipping cost depends on destination and is shown on the auction page and confirmed on the Etsy listing before you pay.
• Outside the EU you may owe import duty or VAT on arrival — that cost and any customs formalities are your responsibility, not the seller’s.

6. The item

Each auctioned piece is hand-cast and hand-finished individually, not mass-produced, so small variations in weight, edge, and finish compared to the photos are normal and not a defect. Your statutory warranty rights (Gewährleistung) for a genuine defect are unaffected and can’t be excluded by these terms. Unless stated otherwise, items are collector’s pieces not intended for children under 14 — small parts, not a toy.

7. Right of withdrawal

As a consumer you have a statutory right to withdraw from the purchase — see our Right of Withdrawal notice for the full terms, deadline, and how to exercise it. This applies to the sale regardless of which checkout the payment runs through.

8. Governing law & disputes

These terms are governed by Austrian law. If you’re a consumer resident in the EU, this doesn’t take away any protection you have under the mandatory consumer-protection law of your own country of residence.

The EU maintains an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and currently do not take part in dispute resolution proceedings before a consumer arbitration board.

9. If a clause turns out to be invalid

The rest of these terms stay in effect; the invalid clause is replaced by whatever comes closest to its intent under applicable law.
